Foreigners who intend to be employed in Shanghai (including those whose remuneration paid abroad and who are assigned to shanghai to work for more than three months ) shall apply for the Employment License for Foreigners of People¡¯s Republic of China (hereinafter referred to as the Employment License ) and Employment Permit for Foreigners (hereinafter referred to as the Employment Permit). The posts to be filled by foreigners in Shanghai shall be the posts essential to the employer, posts of technology, management , or requiring special skills that cannot be filled by any domestic candidates for the time being in China, but violates no government regulations. The employer in Shanghai shall not employ foreigners unless it¡¯s applied and got the Employment License for foreigners. Foreigners who are approved to work in shanghai shall not start working until they hold the Employment Permit and foreigner residence certificate after they enter China. Foreigners shall only work for the employer specified in the Employment Permit and not be allowed to work for the other employers at same time except those foreigners assigned by one foreign investor to work for several enterprises of the same investor. However, only one of these enterprises shall go through the formalities for the foreigner¡¯s employment in this case.
Foreigners who work for the employer in Shanghai without applying for the Employment Permit in accordance with the rules of China and Shanghai shall be handled as illegal employment. |
