In order to carry out The Circular on Further Strengthening Employment Promotion Work by Shanghai Municipal Committee of Communist Party and Shanghai Municipal People’s Government (Document No5 (2003) by Shanghai Municipal Committee of Communist Party (hereinafter referred to as the Circular)), and to encourage enterprises located in City-Based Industry Zones to give employment priority to the local labor force, The Circular on the Opinions in Granting Subsidies for House Rent and Interest Subsidies for Business Start-Up Loans to the Enterprises Located in City-Based Industry Zones is as the follows:
1. The City-Based Industry Zones in Article 6 of the Circular in principle refers to those Industry Zones located within the outer-ring area of Shanghai and verified by the people’s governments of the concerned Districts as City-Based Industry Zones(or Buildings), the “non-public-owned labour intensive enterprises ” refers to those non-public-owned enterprises registered and operated in the same location, and with a per capita production area (calculated on the basis of the rented floor area ) not exceeding 20 ㎡. 2. Non-public-owned labour intensive enterprises stationed in the City-Based Industry Zones for production (hereinafter referred to as the enterprises) may make applications for either subsidies for house rent or interest subsidies for business start-up loans annually before December 31, 2005. While in each year the enterprises may only apply for one item between the subsidies for house rent and interest subsidies for business start-up loans.
3. The enterprises eligible for subsidies for house rent and interest subsidies for business start-up loans shall be those, as of January 2003, have taken advantage of their newly created jobs or currently existing posts to employ persons of the following category: 1) The unemployed; 2) Laid-off workers who still maintain social insurance relationships with their previous employers; 3) People that have received Job-seeking Registration card for Redundant Rural Labourers but failed to be employed in any non-agricultural industries yet. The enterprises applying for subsidies for house rent or interest subsidies for business start-up loans shall enter into labour contracts with the term no less than one year (special labour relationship included) with the above-mentioned people (hereinafter referred to as the unemployed or laid-offs) upon recruitment, and shall also complete the employment registration procedure with the Labour & Social Security Authorities.
4) The enterprises that are to apply for subsidies for house rent or interest subsidies for business start-up loans shall fill the Application Form for subsidies for house rent or interest subsidies for business start-up loans and the Register of the Unemployed and Laid-off workers that have been re-employed by the Enterprises applying for subsidies for house rent or interest subsidies for business start-up loans together with the following documents: 1) Business license (the original copy and photocopies); 2) Certificate of City-Based Industry Zones; 3) Register of employees, Register of local employees, Labour Handbooks or Job-seeking Registration Card for Redundant Rural Labourers of the employees, and the labour contracts (special labour relationship included); 4) House Rent Agreement; 5) The Loan contracts of the enterprises applying for interest subsidies for business start-up loans. Enterprises applying for subsidies for house rent or interest subsidies for business start-up loans shall cooperate actively with the Labour & Social Security Authorities on employment inspections.
5) The amount of subsidies for house rent or interest subsidies for business start-up loans is to be granted according to the standard of each enterprise’s annual payable per capita house rent or loan interest, with consideration on the number of unemployed or laid-off people taken on by the concerned enterprises within the specific year. While the ceiling of annual payable per capita subsidies for house rent or subsidy for loan interest shall be RMB 2000.
6) The subsidies for house rent or interest subsidies for business start-up loans shall be jointly borne by the Municipal Employment Promotion Special Fund and the District’s & County’s Employment Promotion Special Fund respectively at 70% and 30%. The Applications shall be first reviewed by the Labour & Social Security Authorities at district & county level, if approved, the applications will be passed on to the Municipal Labour & Social Authority for verification. Once verified, the Employment Promotion Special Fund at the municipal and district level shall, after examining and confirming the implementation of the labour contracts between the enterprises and their employees who were previously unemployed or laid off, credit their due respective share of subsidies into the bank accounts of the concerned enterprises on a quarterly basis.
7) Relevant issues concerning informal employment organizations stationed and operated in the City-Based Industry Zones shall be implemented in reference to the above regulation. Jointly by Shanghai Municipal Labour & Social Security Bureau and Shanghai Municipal Finance Bureau
